Where a bankrupt owns
land that is not registered the Land Registry will compile
a separate title known as a Caution Title and will provide
a registration number for this. The Caution Title provides
full details of the claim affecting the land and includes
a Title Plan identifying the property. Copies of the
Caution Title can be obtained through LandSearch by applying for a Property Register Search.
The purpose of a Caution Title is to prevent
the sale of unregistered land by an undischarged bankrupt
without the consent of the trustee in bankruptcy.
